Monsieur le Président,
En notre qualité d’autorité centrale cantonale chargée de l’application de la Convention de La Haye du 19 octobre 1996 concernant la compétence, la loi applicable, la reconnaissance, l’exécution et la coopération en matière de responsabilité parentale et de mesures de protection des enfants (CLaH 96), plus particulièrement en vertu de l’article 32, nous nous permettons de signaler la situation du mineur cité sous rubrique.
XXXXXXX, né le 17 avril 2010, est le fils de XXXXXX et XXXXX résidant en Angleterre. Depuis janvier 2023, XXXXX était pensionnaire au collège international de XXXX à XXXXX, en Suisse. Ce dernier a toutefois quitté le collège d’Aiglon le 17 mars 2023 en raison de comportements problématiques pour retourner vivre auprès de ses parents en Angleterre.
Avant son départ, en date du 8 mars 2023, nous avons reçu un signalement de la part de M. XXXXXXX, sous-directeur du collège de XXXXX concernant XXXX. Il ressort du signalement qu’XXXXX a fait part, avant son départ, à plusieurs professionnels, soit notamment l’infirmière scolaire, la psychologue, la logopédiste et le psychiatre qu’il craignait ses parents car ils le frappaient fort, lui donnaient des coups de pied et lui crachaient dessus. Il a dit à plusieurs reprises de ne pas vouloir retourner auprès d’eux en menaçant de s’enfuir. XXXXX a également expliqué aux différents professionnels qu’il ne pouvait pas parler à ses parents de ses idées suicidaires et de ses problèmes d’automutilation, sans que ceux-ci se fâchent contre lui. Il a même ajouté qu’il craignait que ses parents le tuent s’il évoquait ces problèmes. M. XXXXXX a également fait part à la Direction générale de l’enfance et de la jeunesse (XXXX) qu’il n’avait pas informé les parents de la démarche de signalement afin de protéger XXXXX en lien avec la réaction des parents de celui-ci et du risque de représailles. Il ressort, toutefois, du signalement qu’il est difficile d’attester la véracité des propos tenus par XXXXX, étant précisé que celui-ci présente des troubles psychiques récurrents.
Selon les informations à notre disposition :
La mère de XXXXX, XXXXX est domiciliée à XXXXXX Road., Santon, Isle of Man, IM4 2HR UK et son numéro de téléphone est le +XXXXXXXX.
Quant au père de XXXXX, XXXXXXX, celui-ci est domicilié à XXXXXXX, XXXX Road, Horsham, RH12 4HL, UK et son numéro de téléphone est le +XXXXXXXXX.
Compte tenu de la résidence habituelle de XXXX en Angleterre, les autorités anglaises sont aujourd’hui compétentes pour prendre toute mesure tendant à la protection de celui-ci, conformément à l’article 5 CLaH96. Au vu des éléments relevés ci-dessus et n’ayant que très peu d’informations sur les conditions de vie actuelles de XXXXXX, nous sommes très inquiets quant à sa situation et sa prise en charge auprès de ses parents en Angleterre. Nous ne sommes en effet pas certains que son bon développement soit garanti. Aussi, nous vous saurions gré de transmettre le présent courrier aux services sociaux compétents afin qu’ils évaluent ses conditions d’existence auprès de ses parents et sollicitent, selon les circonstances, les mesures de protection qui s’imposent.

Mr. President,
As the Central Cantonal Authority responsible for the application of the Hague Convention of 19 October 1996 on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in respect of Parental Responsibility and Measures for the Protection of Children (CLaH 96), in particular under article 32, we would like to draw your attention to the situation of the minor in the heading.
XXXXX, born on April 17, 2010, is the son of Marie-Stéphanie and Samir XXXXXX living in England. Since January 2023, XXXXX was a boarder at the XXXXX International College in XXXXXX, Switzerland. However, XXX left XXXX College on March 17, 2023, due to problematic behavior and returned to live with his parents in England.
Prior to his departure, on March 8, 2023, we received a report from Mr. XXXXXXX, deputy director of XXXXX College regarding XXXXX. It appears from the report that XXX told several professionals before his departure, notably the school nurse, the psychologist, the speech therapist and the psychiatrist, that he was afraid of his parents because they have hit him hard, kicked him and spat on him. He repeatedly said he did not want to return to them, threatening to run away. XXXXX also explained to the various professionals that he could not talk to his parents about his suicidal thoughts and self-harming problems without them getting angry at him. He even added that he was afraid his parents would kill him if he brought up these issues. Mr. XXXXXXX also informed the General Directorate of Child and Youth of canton Vaud in Switzerland (DGEJ) that he did not inform the parents of the reporting process in order to protect XXXXX from the potential reaction of his parents and the risk of reprisal. However, it appears from the report that it is difficult to attest to the veracity of the statements made by XXXX, being specified that he presents recurring psychic disorder.
According to the information at our disposal:
XXXX's mother, Marie-Stéphanie XXXX is domiciled at The XXXX, XXXXX Road, Santon, Isle of Man, IM4 2HR UK and her phone number is +XXXXXXXXXX.
XXXXX's father, Samir XXXXX is domiciled at XXXXX, XXXXX Road, Horsham, RH12 4HL, UK and his phone number is +XXXXXXXXXXX.
Given XXXXX's habitual residence is England, the English authorities are now competent to take any measure for his protection, in accordance with Article 5 CLaH96. In view of the above elements and having very little information about XXXX's current living conditions, we are very concerned about his situation and his well-being with his parents in England. We are not sure that his proper development is guaranteed. Therefore, we would be grateful if you would forward this letter to the competent social services so that they can evaluate his living conditions with his parents and request, depending on the circumstances, the necessary protective measures.
