Bij een groot aantal wetsartikelen is niet alleen het wetsartikel vermeld maar ook de maatschappelijke classificatie. Een maatschappelijke classificatie is de omschrijving van het delict in ‘gewone’ bewoordingen, zoals ‘diefstal van fiets’ of ‘straatroof’. Daarmee wordt een wat algemener wetsartikel eigenlijk verder gepreciseerd. Bijvoorbeeld wetsartikel SR 350 beschadiging heeft onder andere als maatschappelijke classificatie ‘het beschadigen van auto’s’ of als maatschappelijke classificatie ‘het vernielen van openbare gebouwen’.

V.13.2 Data from the Public Prosecution Service The data below concerns the information that is known to the Public Prosecution Service about cases of violence against women. The gender of the deceased person is not recorded in a systematic way in murder and manslaughter cases. In cases in which a victim has died due to a criminal offence, the surviving relatives or family members are also victims within the meaning of the law (Section 51a of the Dutch Code of Criminal Procedure). Although the Public Prosecution Service records victims, in these criminal offences they are surviving relatives or family members of the deceased person. In other offences as well, family members cannot always be properly distinguished from the person the offence was perpetrated against. The data of the cases the Public Prosecution Service has recorded in the social classification as ‘domestic violence – partner abuse’ and ‘honour-related violence’ follows below. The system does not register whether the victim was male or female.

In the data system we have to search by article of law. In the Netherlands we have in the criminal law article SR 273f, human trafficking is covered by that article. However article SR 273f includes more, exploitation is also covered by this article. Besides that, we cannot make a proper distinction between forced labor crimes and sex trafficking crimes with only this article of law. We have therefore combined the article with the “social classification ” in the data system. We used the social classification “Mensenhandel arbeid/ diensten (niet seksueel)“ (corresponding to forced labor crimes) and “Mensenhandel seksuele uitbuiting“ ( corresponding to sex trafficking crimes). This social classification field in the data system is usually filled in by the office of the prosecution (OM), but not in all cases this field is filled in.

If you wanted to deviate from a literal translation you could opt for:
Kwalificatie --> Classification [van Dale: kwalificatie (juridisch) characterization, classification]
Maatschappelijke classificatie --> Further classification
Blijkens artikel 2 in samenhang met artikel 7, eerste lid, van het Besluit justitiële gegevens (Bjg) wordt een beslissing van een rechter als een justitieel gegeven aangemerkt. Dat geldt ook voor de strafbepalingen van het strafbare feit, de kwalificatie en maatschappelijke classificatie daarvan.
In de nota van toelichting bij het Bjg (Stb. 2014, 130) staat:
"(…) Met classificatie (eerste lid, onder e) wordt bedoeld een nadere aanduiding van het feit dat inzicht geeft in het soort overtreding. Gedacht kan daarbij worden aan de classificatie «tasjesroof» bij diefstal. Een dergelijke classificatie geeft enig inzicht in de zwaarte van het gepleegde feit.(…)"
De term “maatschappelijke classificatie” als bedoeld in het bepaalde in artikel 7, eerste lid, aanhef en onder e, van het Bjg is dus een specificatie van het strafbare feit.

Dat 'maatschappelijk' in 'maatschappelijke classificatie' schijn te duiden op wat er meer precies in het echt (in de maatschappij/in the real world) is gebeurd.

I think a case can be made out for a literal translation.
It seems almost impossible to translate this 'maatschappelijk' here.
I think I understand what they mean: a classification whose members are defined in a manner closer to [the social] reality, to what has happened in the real world.
'subclassification' implies a classification whose members are more precisely defined than those of the primary classification.
But it does not makes sense to add 'social': social subclassification.
It seems to be a choice between 'social classification' vs 'subclassification' as a possible alternative.
I do care a lot about the 'exact contextual meaning' of text. :-)
4) Communicative translation
This type of translation attempts to render the exact contextual meaning of the original text in such a way that both content and language are readily acceptable and comprehensible to the reader. It is particularly suitable when translating conventional formulae or proverbs and it involves some levels of cultural approximation. Communicative translation aspires to create the same effect created by the SL text on the TL reader. Though it is not as accurate as semantic translation which sticks to the original text, it communicates the meaning at the expense of accuracy. However, it is preferred by many translators because it resorts to concepts that are more familiar to the TL reader on cultural and social levels. It is usually used for culturally specific idioms, proverbs or clichés where the translator replaces a SL word or concept with one that already exists in the TL.

You could also say 'brief summary'.
Yes, that is a possibility. The translation has been sent to the customer now. I note from various google searches that these classifications are standardized and many offences are simply classed as "overige" (other). I'm afraid I opted for the literal translation. I doubt if the receiving authority will be particularly concerned. Such concern I fear is limited to our small hair-splitting circle of professional translators. |
Thanks for your reply. Your proposal could be used in certain contexts where a more extensive translation would be in order, but as an entry on a statement of criminal record I preferred to stick with the calque. |
