I am proofreading a document and the above has been translated as : the rules of the arts such as applicable at the time of the Facility Services.

It is the term de kunst' (the arts) that does not fit a contract for building a prison.

De Facilitaire Diensten moeten vanaf de Beschikbaarheidsdatum worden verricht in overeenstemming met (i) het Programma van Eisen, (ii) het Plan Facilitaire Diensten (dat jaarlijks wordt geactualiseerd), (iii) de toepasselijke Regelgeving en (iv) de regels van de kunst zoals van toepassing op het moment van de Facilitaire Dienstverlening.

'State of the art' (no 's') represents a fact (the state of that profession at that time), it is not something you can apply. I would go with 'best practices.

I don't think "regels van de kunst" can be translated as "state of the art".

"state of the art", refers to the "LEVEL of development", which is not what the asker's src text says, iyam.

Merriam-Webster's:

"state of the art =
the level of development (as of a device, procedure, process, technique, or science) reached at any particular time usually as a result of modern methods" (https://www.merriam-webster.com/dictionary/state of the art )

Asker's txt says:

"REGELS van de kunst"

"regels" are rules
Asker's text does not say "stand" (which would indeed be "level")

Oxforddictionaries.com defines "best practice" as:

"Commercial or professional procedures that are accepted or prescribed as being correct or most effective"

...so I think this can be used as a translation of "volgens de regels van de kunst".

However, another option might be "according to the rules of the trade" (volgens de regels der kunst).

"best practice" is used in myriad contexts, incl. construction. nothing wrong with "rules of the trade"; it's used in all kinds of contexts. see my refs. "the trade" means: "The people engaged in a particular area of business".

agree writeaway : this is standard stuff in any case. rules of the arts is pretty hilarious. so is "such as applicable at the time of the Facility Services".

agree Michael Beijer : agree w/ "best practice", but not "state of the art" (= stand van de technologie/techniek, modernste technologie, etc.) or "the very highest standards". I think you could also tr this as: "according to the rules of the trade" (volgens de regels der kunst)

op de wijze zoals een degelijke vakman van dezelfde beroepscategorie, geplaatst in dezelfde omstandigheden, dit zou gedaan hebben. De naleving van de regels van de kunst moet worden beoordeeld volgens de aard van het werk dat het voorwerp van de overeenkomst uitmaakt en volgens de prijs van de aanneming.

Agree 'state of the art' is not what is meant. Basically it means that you do your work according to what currently is being seen as professional/ more simply, as you are supposed to do your work.
