作為(不作為)の蓋然性
a balance of probabilitiesは欧米の民法上の原則の一つで、原告の立証責任につき、下記サイトの通り「問題となっている作為又は不作為が存在した可能性の方が高い」ことを意味します。日本の民法では、原告の立証責任につき緩和しているのは、製造物責任法などがありますが、そのまま該当する用語はないように思われます。ここでは、「作為(不作為)の蓋然性」と試訳してみました。
