From the defense attorney's arguments in a JFTC ruling, which is definitely splitting hairs in my opinion, but in any case the argument makes a distinction between 「すること」、「することとなる」、「するおそれがある」。Here is the whole phrase: 特許・ノウハウガイドラインの用語によれば,本件非係争条項が違法となるのは,本件非係争条項によって,「ライセンシーの研究開発の意欲を損ない,新たな技術の開発を阻害すること」の場合であり,「ライセンシーの研究開発の意欲を損ない,新たな技術の開発を阻害『するおそれがある』」や「ライセンシーの研究開発意欲を損ない,新たな技術の開発を阻害『することとなる』」では足りない

Hello Davi, you appear to be battling with very interesting subject. I understand it is quite a challenge.
As for this question of yours, it seems to me that what they are talking about is the matter of clarification and comparison.
In other words, these three are 「すること」、vs. 「するおそれがある」 and 「することとなる」 comparison.
Therefore, the first is definitive (and illegal). The latter two are suppositions, thereby do not qualify to be so.
Merely being 「するおそれがある」 and 「することとなる」 are not sufficient to be illegal.
You are right, they are splitting the hair. But することとなる is not quite there.
