French term

alors que vous y étiez seul

French to English Law/Patents Idioms / Maxims / Sayings
This is one expert witness making a formal response to another. He has just said that his company had raised no objects to the experiment conducted by the other expert witness on the causes of the defects that are at issue in the lawsuit, but that they did not realize that that would be the sole basis of his opinion, when he had, in fact, been alluding to other ongoing research.

He then says:

And this is followed by a copy of his June email.

I am not sure how to unpack this sentence, especially "alors que vous y étiez seul". I showed it to a native-speaking colleague and she said that it seemed poorly and confusingly written, and could not see who "alors que vous y étiez seul" and "et sans avoir répondu à ma demande circonstanciée" related to each other and the rest of the sentence. I am hoping someone can help me make sense of this.

Thanks in advance.

Discussion

Wolf Draeger Feb 15, 2013:
Y être means to understand or know something, so maybe the writer means to say "which only you know/are aware of", implying that the research may never have been done to begin with.

Which you have so far kept to yourself?
MSA-Translation (asker) Feb 15, 2013:
Yes, Victoria, you have imagined the situation correctly. This is what I understand it to be saying too. What I am searching for is a way to render this passage in English.
Victoria Britten Feb 15, 2013:
short on context What was the first "campagne"? With what you have given us, I could imagine that a first set of samples was taken for both expert witnesses to interpret and that one of them then decided to conduct a second sampling session and is now being asked - not for the first time - to let the results of his analysis be known. It isn't brilliantly well written, but of course presumably both parties knew what was being talked about...

while you were undertaking your own analysis

while you were carrying out an analysis of the causes of the defects, on your own

A possible explanation:

Where are the results of the other research into the causes of the defects?
While you were researching on your own, you did not reply to my detailed email....... in reply to your message..... in which I wrote:..........

(The context provided seems to be incomplete. What did the expert witness write?)

which you carried out alone

I think this is a way of stressing the fact that the expert witness being questioned should know where the results of the second campaign were, because he carried out the analysis single-handed. Apparently these results were not forthcoming despite the request of the other expert witness.

which only you have seen

I think this is the idea behind it: come on, I can't analyse the sample because you carried it out alone, but please share the results so that we can base our conclusions on the same evidence.

when you were the only one working on it

two things here - "alors que vous y étiez seul" meaning that whatever he/she was doing, they were doing it on their own; and then "et sans avoir répondu à ma demande circonstanciée, par courrier électronique du XX Juin 20XX dans lequel, en réponse à votre message du XX Mai 20XX, j’écrivais ( avec copie à mes confrères) :" which is another thought, where he/she is reproaching someone else for not replying to a detailed request for information etc. It's badly written but if this is a transcript, that is how people talk.
