In the construction of some documents (particularly statutes) an artificial construction is given to a word or phrase that ordinarily would not be so construed, in order to clarify any doubt or as a convenient form of drafting shorthand. In Black's Law Dictionary (Garner) staat onder 'deem': Deem has been traditionally considered to be a useful word when it is necessary to establish a legal fiction either positively by 'deeming' something to be what it is not or negatively by 'deeming' something not to be what it is (...) |

Specifiek voor de VS: Deemed Export Definition A deemed export release in the United States is a release of technology or source code that is subject to the Export Administration Regulations to a foreign national. Such release is "deemed" to be an export to the home country or countries of the foreign national.
