ΕΙΣΑΓΩΓΗ
Η σύγκρουση ανάμεσα στο δικαίωμα προστασίας των προσωπικών δεδομένων και στο «δικαίωμα στην ασφάλεια» παρουσιάζει ιδιαίτερο ενδιαφέρον, όχι μόνο γιατί άπτεται του σκληρού πυρήνα της προστασίας των ατομικών δικαιωμάτων, αλλά και γιατί αγγίζει πια την καθημερινή ζωή του καθενός που καλείται να επιλέξει ανάμεσα σε μια τεχνολογία που έρχεται να του προσφέρει όλο και πιο σύγχρονα μέσα για την επίτευξη μιας απροσδιόριστης μορφής ασφάλειας και σε έναν ιδιωτικό βίο που ολοένα συρρικνώνεται.
Η έννοια της Δημόσιας Ασφάλειας στην οποία θα αναφερθούμε στην παρούσα εισήγηση, αφορά τις πολιτικές πρωτοβουλίες και τα μέτρα που λαμβάνονται σε κυβερνητικό (εθνικό ή διεθνές) επίπεδο για την προστασία κυρίως από τρομοκρατικές επιθέσεις και στο πλαίσιο της διακρατικής συνεργασίας για την αντιμετώπιση της τρομοκρατίας.
Όπως καταλαβαίνετε, όλα ανάγονται στην 11η Σεπτεμβρίου 2001. Μετά την ημέρα αυτή ο πλανήτης έχει γίνει μάρτυρας μιας σειράς πρωτοβουλιών που συντείνουν, στο όνομα της ασφάλειας, σε μια «ελεγχόμενη συρρίκνωση δικαιωμάτων».
Κανείς δεν αρνείται τον φόβο μπροστά σε άγνωστα ενδεχόμενα και κανείς δεν θα μπορούσε εξάλλου να αναλάβει την ευθύνη από μια πλημμελή πολιτική στον τομέα της ασφάλειας. Δεν μπορούμε όμως να μην παρατηρήσουμε ότι η «ανοιχτή κοινωνία» δεν είναι πια αυτό που ήταν και ότι οι κάθε είδους πρωτοβουλίες για τη μετάβαση από την «ανοιχτή κοινωνία» σε μια «κοινωνία της ασφάλειας» εμφανίζονται «κατά ριπάς» χωρίς να υπάρχει δυνατότητα να ακουστεί η αντίθετη άποψη.
Σε διεθνές επίπεδο, αναφέρουμε χαρακτηριστικά:
α) τις πρωτοβουλίες των ΗΠΑ για πρόσβαση στα προσωπικά δεδομένα των επιβατών (PNR) που ταξιδεύουν αεροπορικώς προς αυτές καθώς και τις νέες νομοθετικές ρυθμίσεις για ενσωμάτωση βιομετρικών δεδομένων στις θεωρήσεις.
β) τις πρωτοβουλίες της ΕΕ για ενσωμάτωση βιομετρικών δεδομένων στα ενιαίου τύπου ευρωπαϊκά διαβατήρια και τις θεωρήσεις και για τη δημιουργία ηλεκτρονικού συστήματος πληροφοριών θεωρήσεων (VIS)
γ) το ευρωπαϊκό «Πρόγραμμα της Χάγης» για ελεύθερη ανταλλαγή πληροφοριών των αστυνομικών υπηρεσιών και την αξιοποίηση πληροφοριακών συστημάτων όπως η SCHENGEN, η EUROPOL, η EURODAC, η EUROJUST κλπ.
Το θέμα παρουσιάζει πάντως μια ιδιαιτερότητα. Η Οδηγία 95/46/ΕΚ για την προστασία των φυσικών προσώπων έναντι της επεξεργασίας δεδομένων προσωπικού χαρακτήρα και για την ελεύθερη κυκλοφορία των δεδομένων αυτών, δεν εφαρμόζεται στον τομέα της αστυνομικής συνεργασίας και γενικά του 3ου πυλώνα.
Γι’ αυτό η προστασία των προσωπικών δεδομένων στους τομείς αυτούς ρυθμίζεται με ειδικότερο τρόπο στις εθνικές νομοθεσίες των κρατών-μελών ή αποτελεί σε ευρωπαϊκό επίπεδο αντικείμενο ειδικότερων διεθνών συμφωνιών, όπως η Συνθήκη Σένγκεν και η Σύμβαση εφαρμογής της, η Σύμβαση της EUROPOL και οι αποφάσεις για τη δημιουργία της EURODAC και της EUROJUST, όπου υπάρχουν ειδικές ρυθμίσεις για την προστασία των δεδομένων.
Στη χώρα μας ο Ν. 2472/97 για την προστασία του ατόμου από την επεξεργασία δεδομένων προσωπικού χαρακτήρα, εφαρμόζεται και στα αρχεία του τρίτου πυλώνα.
Στο πλαίσιο της εισήγησης αυτής θα παρουσιάσουμε τη «νομολογία» της Αρχής Προστασίας Δεδομένων στον τομέα της δημόσιας ασφάλειας, επιλέγοντας τρεις χαρακτηριστικές υποθέσεις με διαφορετικά χαρακτηριστικά, αλλά με κοινό στοιχείο τη διεθνή διάσταση της θεματικής τους.
Translation - English PUBLIC SECURITY AND PERSONAL DATA PROTECTION
INTRODUCTION
The conflict that exists between the right to the protection of personal data and the “right to security” is particularly interesting, not only because it touches upon the core of the protection of personal rights but also because it affects the everyday life of anyone who has to choose between technology, which offers increasingly more sophisticated means for achieving an indefinable form of security, and a private life which is constantly shrinking.
The concept of Public Security, to which we refer in the current paper, concerns the political initiatives and the measures taken at governmental level (national as well as international), mainly for the protection against terrorist activities and in the framework of transnational cooperation for the fight against terrorism.
It is evident that it all goes back to 9/11. The attacks that took place on that day led to a series of initiatives, which conduce, in the name of security, to a “controlled shrinking of rights”.
Nobody denies having feelings of fear in view of the unknown and of course nobody could take on the responsibility for an inadequate policy in the area of security. Still, we cannot but observe that the “open society” is no longer what it used to be and that all the initiatives that are taken for the transition to a “secure society” are “overwhelming” and leave no room for the opposite view to be heard.
At an international level, we refer indicatively to:
1.the initiatives taken by the USA for access to passengers' personal data (PNR) when flying to the USA as well as the new legislative regulations for the incorporation of biometric data in visas.
2.the EU initiatives for the incorporation of biometric data in the new uniform EU citizens' passports and visas and for the creation of an electronic visa information system (VIS).
3.the European “Hague Programme” for the free exchange of information among police services and the maximal use of information systems such as SCHENGEN, EUROPOL, EURODAC, EUROJUST, etc.
The issue, however, is not straightforward. Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data does not apply to the area of police cooperation and, in general, to the third pillar.
As a result, the protection of personal data in these areas is regulated by the national legislation of the member-states or it constitutes the object of specific international agreements, like the Schengen Convention and the Convention for its implementation, the EUROPOL Convention and the decisions for the set-up of EURODAC and EUROJUST, where there are special regulations for the protection of data.
In Greece, Law 2472/97 on the Protection of Individuals with regard to the Processing of Personal Data also applies to the records of the third pillar.
The present paper sets out to present the “jurisprudence” of the Data Protection Authority in the area of public security, by focusing on three representative cases which have different characteristics but deal with topics of an international character.
