It seems that mainly multinationals have active patent and licensing strategies. Patent litigation cases in the international business arena get regular media attention such as the one following Samsung's alleged infringement of some of Apple's mobile device patents. You could wonder why small and medium sized enterprises are passive in that field. We discovered that management of those businesses are not always aware of the financial potential its novelties and intellectual property represent.
There may be no time, nor the financial resilience to follow through on patent registration. Even more so than small businesses, individual inventors usually do not have the resources to pay for patent law and commercial strategy consultants. Filing a patent application is a lengthy process. The exercise of writing the application may already seem intimidating. Many times, home-grown inventions are only used for a company's own line of products. True, it may deliver competitive advantage at short notice. Long term benefits however, are left alone.
Business model
We offer inventors the opportunity to legally claim and market their innovative technology. We do so by providing our knowledge, experience and financial resources to a joint venture in which we participate with the inventing party. We take care of your invention and our services may range from defining and executing the licensing strategy, to writing and filing the patent application up to the defense of your intellectual property. This requires business, financial, legal and technological skills, which we have, and a lot of hard work, which we are willing to provide.
Roadmap to a profitable invention
We are dedicated to establishing long-term business partnerships with small and medium-sized companies as well as individual inventors. When a business opportunity presents itself we make a first assessment of whether we are interested in taking an in-depth look at it. If we are interested, we conduct a due diligence, in which we look at the technical feasibility of the invention, its business potential and the scope and validity of the patent rights. As you can imagine, many prospects fail at this stage.
If the prospect passes our due diligence criteria we enter into negotiations with the owner(s) of the invention. Although each case will be different, the main point is that we will take a risk-bearing interest in the invention, and will provide our share of the capital needed to come to a successful patent monetization strategy.
The capital needs can be the cost of obtaining and maintaining the patent, technological research that may be required to prove that the invention works, travel expenses for face-to-face licensing negotiations, outside market research studies, etc. We also invest in the venture by providing our services without charging a fee. In return for our investment we want a share of the proceeds.
Our business criteria
Because we put our own time and money at risk, our due diligence is thorough and the invention should meet strict criteria to enlarge to changes for a successful licensing strategy:
• The invention needs to be a 'game-changing' technology that is considered a true novelty and able to impact or change industries or competitive landscapes.
• The invention needs to have a broad scope to open up worldwide business potential; it should be applicable in multiple applications, multiple industries and multiple countries.
• The ultimate patent needs to be of high quality to survive nullity procedures, infringement and litigation.
Clearly, a valuable invention itself is the starting point. However, if not backed-up with a robust plan for approaching prospective licensees and a profound legal strategy it will never stand the chance of finding its way into the licensing market and deliver profitable business agreements. Wij bieden uitvinders de mogelijkheid om hun innovatieve technologie wettelijk vast te leggen en te vermarkten. We doen dat door onze kennis, ervaring en financiële middelen aan te bieden in een joint venture waarin we samen met de uitvinder deelnemen. We zorgen voor uw uitvinding en bieden diverse diensten, bijvoorbeeld formulering en uitvoering van de licentiestrategie, beschrijving en indiening van de patentaanvraag, en verdediging van uw intellectueel eigendom. Dit vereist zakelijke, financiële en technologische vaardigheden, en inzicht in wetgeving. Dat hebben we. Bovendien vereist dit veel en hard werken. En dat doen we graag.
Routekaart naar een winstgevende uitvinding
Wij streven naar het ontwikkelen van langdurige professionele samenwerkingsverbanden met kleine en middelgrote bedrijven, evenals met individuele uitvinders. Wanneer zich een zakelijke kans voordoet, dan bekijken we eerst of het interessant is om diepgaander onderzoek te doen. Als dat het geval is, dan voeren we een due diligence uit. Hierbij kijken we naar de technische haalbaarheid van de uitvinding, de commerciële kansen en de reikwijdte en geldigheid van de octrooirechten. Als de kandidaat voldoet aan onze due diligence-criteria, dan openen we de onderhandelingen met de eigenaar(s) van de uitvinding. Een belangrijk punt is dat we een risicodragend aandeel nemen in de uitvinding door ons deel van het kapitaal aan te leveren dat nodig is om het patent met succes te kapitaliseren.
Kapitaal kan nodig zijn voor dekking van de kosten die nodig zijn om het patent te verkrijgen en te houden, voor technologisch onderzoek dat mogelijk nodig is om te bewijzen dat de uitvinding werkt, of reiskosten voor face-to-face licentie-onderhandelingen, door derden uitgevoerd marktonderzoek, etc. We investeren ook in de joint venture door onze diensten te leveren zonder deze in rekening te brengen. Als tegenprestatie voor onze investering vragen we een aandeel in de opbrengst.
Onze bedrijfscriteria
Omdat we onze eigen tijd en geld inzetten, is onze due diligence grondig en moet de uitvinding aan strenge criteria voldoen om de kansen op een succesvolle licentiestrategie te vergroten:
• De uitvinding moet ‘baanbrekende’ technologie zijn die als een echte noviteit wordt beschouwd en moet in staat zijn de markt of concurrentie ingrijpend te beïnvloeden of veranderen.
• De uitvinding moet een reikwijdte hebben die wereldwijd grote zakelijke kansen biedt, en toepasbaar zijn op meerdere toepassingen, meerdere industrieën en meerdere landen.
• Het uiteindelijke patent moet van dusdanig hoge kwaliteit zijn dat het nietigheidsprocedures, beschuldigingen van inbreuk en gerechtelijke acties kan overleven.
Het is duidelijk dat een waardevolle uitvinding op zich het startpunt is. Als de uitvinding echter niet wordt onderbouwd met een robuust plan dat zich richt op de verwerving van kandidaat-licentienemers en niet is gegrond op een degelijke juridische strategie, dan maakt het geen kans om ooit vaste voet te krijgen op de licentiemarkt en tot winstgevende zakelijke overeenkomsten te komen. Wij zijn experts op deze gebieden en heeft dit internationaal bewezen.
Door hun eigen expertise, kapitaal en tijd in de joint venture te steken, wordt door ons de weg geplaveid naar een succesvolle kapitalisatiestrategie, worden financiële obstakels weggenomen en wordt compensatie geboden voor beperkte kennis. On the completion of a four-year study in 1990 I was awarded the official 'Translator and Interpreter of English' Dutch State Certificate. In addition I followed a supplementary law translation course. I am specialized in the translation of documents relating to technical subjects (engineering, electronics, machinery, household appliances etc.), software, hardware, Web, HTML - but also contracts, marketing documents, and documents of a general nature can be translated. I am a highly experienced translator.
Experience
Since 1990 I have acquired a great deal of experience in the translation of documents on a wide variety of subjects. I have worked for a large number of translation agencies and direct customers, and have also participated in a number of (in-house) (multi-translator) projects, although today, I predominantly work from my home office. I am specialised in technical subjects and information technology, although I have also translated documents on a wide variety of other subjects. Examples include: water purification plants, hardware integration in multifunctional networks, articulated booms, elevators, lifting equipment, conveyor belt systems, operator and maintenance manuals for meat-processing machinery, fire detector systems, airconditioning systems, user manuals for a wide variety of consumer products such as mobile telephones, VCRs, TV sets and GPS equipment, software programmes, HTML text, and integrated software and hardware modules, as well as marketing documents, interviews, presentations, architectural books, and many other subjects. Particulary, in the past 12 years I have performed numerous assignments in the field of photography and video, mobile telephones, agriculture centering around machinery like combine harvesters, balers, mower-conditioners, pick-ups, etc., medical appliances (equipment such as stretchers, stair chairs, etc.), wrapping/stacking/gluing machines, multifunctional devices for the printing/copying industry, and business security software (antivirus, end user internet access monitoring, event logging, archiving, digital faxing, etc.).
